Ziberi: There is no equal improvement of ethnic representation in institutions

There is no equal improvement in the adequate and equitable representation of smaller communities in all public sectors in 2020. In state bodies such as the Assembly, the Ombudsman, the Government, ministries and local self-government units, the situation has significantly improved, but in public enterprises, prosecutor's offices and courts there is a delay in the implementation of this principle.

Ombudsman Nasser Ziberi today at a press conference presented the data on compliance with the principle of non-discrimination and adequate and equitable representation, as well as gender representation in the public sector for 2020.

In order to implement this activity, the Ombudsman submitted requests to 1345 institutions, of which 1.209 responded. A total of 136 institutions did not submit data on the situation with the application of the principle of adequate and equitable representation of communities in state government bodies, and in the public sector and local self-government as a whole.

According to Ziberi, starting from 2007 when this analysis was applied until today, the general conclusion is that there is an improvement in the direction of ethnic representation of citizens in state bodies, bodies of local self-government units and the public sector as a whole.

As an illustration, he cited the fact that in 2007 Albanians were represented by 10,8 percent, and in 2020 that percentage is 20,1. Turks in 2007 were represented by 1,1 percent, and in 2020 by 2,1 percent.

Roma were represented by 0,8 percent, and now they are by 1,3 percent. The Vlachs are at the same level, the Bosniaks were with 0,3 and now they are with 0,5 percent.

- Unfortunately, there is no improvement of the situation equally in all sectors, institutions and bodies. In some of the state bodies, such as the Assembly, the Ombudsman, the Government, ministries, local self-government units and in some of the larger funds, the situation has significantly improved. But even here, not for all communities equally, Ziberi said.

The analysis of the data shows that the representation is not the same in terms of structure in terms of education, managerial and non-managerial positions.

- Hence, the data show that in the managerial positions the representation of the smaller communities is far less than the number of employees. In contrast, the situation of the elected and appointed persons corresponds to their representation, added Ziberi.

The Ombudsman, noting these conditions, recommends taking more serious measures in order to respect this fundamental value and the recommendations are addressed to all institutions depending on the situation that has been identified.

In fact, the Ombudsman, acting on the complaints in the annual report for 2020 or 2021, concluded that in order to improve the application of this principle, the application of the legal solution for the so-called balancer in community representation.

Hence, the Ombudsman's recommendation to the Ministry of Information Society and Public Administration is to deal more seriously with finding an appropriate mechanism that will eliminate the abuse of the so-called balance sheet and the principle of equitable and adequate representation to be implemented as stipulated in the Constitution.

As Ziberi informed, in the state bodies, such as the President, the Assembly, the Government, the Constitutional, Supreme and Administrative Courts, the National Bank, the representation for 2020 is as follows: Macedonians are 75,6 percent, Albanians 17,7 percent, Turks 1,6 percent, Roma 1 percent, Serbs 1,7 percent, Vlachs 1,7 percent, Bosniaks 0,5 percent and the remaining 0,3 percent.

According to the Ombudsman, these data show that in 2020 there was no improvement in representation, and in some bodies it is even more pronounced, such as the Cabinet of the President and the Constitutional Court.

Ziberi emphasized that in some bodies such as the Macedonian Academy of Sciences and Arts, there is a big deviation in terms of the application of this principle, ie the representation of the smaller communities. 95,7 percent of the employees at MANU are Macedonians, and only 1,4 percent are Albanians.

In the ministries, the ombudsman said that the situation as a whole has improved, but even here the representation in terms of managerial and non-managerial positions does not correspond.

Ziberi publicly criticized the Ministries of Finance and Transport and Communications for not responding to the Ombudsman's request and for 2020 not submitting data on the representation of communities in their area.

The situation in the ministries as a whole is as follows: Macedonians are 69,9 percent, Albanians 24,3 percent, Turks 1,9 percent, Roma 1 percent, Serbs 1,5 percent, Vlachs 0,5, Bosniaks 0,6 percent and the rest 0,3 , XNUMX percent.

The Ombudsman concluded that the trend of representation of smaller communities in the ministries is still unsatisfactory, especially in the management positions. Therefore, the Ombudsman recommends the establishment of a system of consistent implementation of the principle of adequate and equitable representation.

In public institutions and other legal entities such as agencies, directorates, commissions, institutes the situation is as follows: Macedonians 76,8 percent, Albanians 17,6 percent, Turks 1,8 percent, Roma 0,8 percent, Serbs 1,4 percent , Vlachs 1,4 percent, Bosniaks 1,4 percent and the remaining 0,4 percent.

- The analysis of the data shows that in these institutions in 2020 there is an increase in the number of employees by 365 people, compared to the previous year, but only in a small part of these institutions there is an improvement of the ethnic status of representation according to this criterion, said Ziberi.

He added that in some of the institutions the situation with representation is worrying. He cited AD as an example for construction and management of state-owned housing and business premises, where the structure is as follows: Macedonians 90,6 percent, Albanians 2,6 percent, Turks 0,6 percent, Roma 1,8 percent, Serbs 2,6, 1,2 percent, Vlachs 0,3 percent, Voshnjaci 3 and the remaining XNUMX percent.

- In some institutions the situation is even more glaring. For comparison, I will mention the State Inspectorate for Technical Inspection, where 96 percent are Macedonians, 0 percent are Albanians. The situation is similar in the Center for Development of the Skopje Mountain Region, where, except for Macedonians, no other ethnicity is employed, the Ombudsman added.

In the penitentiaries and educational institutions, the analysis and data show that the representation in these institutions is as follows - Macedonians 78,9, Albanians 17,6, Turks 1,1, Roma 0,4, Serbs 1, Vlachs 0,8, Bosniaks 0,1 and remaining 0,2 percent.

Ziberi added that the presented data show progress in implementing the principle of adequate and equitable representation in these institutions, especially in the larger ethnic community - the Albanian, which in the last year employed 62 members of this community.

In public enterprises, the data show a much lower representation of communities. Thus, in general, in public enterprises is next Macedonians 74,2, Albanians 15,8, Turks 1,8, Roma 4,1, Serbs 1,7, Vlachs 0,5, Bosniaks 0,7 and the remaining 1 percent.

As a more glaring example, Ziberi mentioned the public institution Zoo of the City of Skopje, where out of the total number of 48 employees, only one is from the Albanian community, and not a single Turk is employed.

Considering the situation, the Ombudsman recommends serious implementation of the principle of adequate and equitable representation in public enterprises.

- The situation with the funds is different. In terms of number of employees in larger funds such as the HIF and PDIF, the two largest communities - Macedonian and Albanian are represented by Macedonians with 70,5, Albanians 25 percent, but the situation with the representation of the Turkish community with only 0,7 percent is worrying. Roma with only 0,3 percent, added Ziberi.

Hence, the Ombudsman's recommendation to these funds is to make additional efforts to make the smaller communities more adequately represented.

But the situation with the two smaller funds - FITR and the Deposit Insurance Fund, according to Ziberi, the situation is very worrying. As an example, he cited FITR where, apart from the Macedonian ethnic community, no other ethnic community is employed.

- The judiciary also can not say that the situation is good. On the contrary, there is no progress in improving the situation in the judiciary, Ziberi said.

Of the total number of employees in the judiciary at all levels of courts, Macedonians are 78,9, Albanians 15, Turks 1,5, Roma 0,9, Serbs 1,4, Vlachs 1,1, Bosniaks 0,8 and others with 0,5, XNUMX percent.

The Ombudsman recommended that the judiciary take additional steps to improve the situation and as a special criticism directed to the Basic Civil Court Skopje, which for 2020 did not send data on the situation of their number of employees and ethnicity of employees.

- It is even more worrying in the prosecutor's offices compared to the judiciary. 81,9% of the total number are Macedonians, 12,1% are Albanians, 2,3% are Turks, 0,8% are Roma, 0,8% are Serbs, 1,5% are Vlachs, 1,3% are Bosniaks and the remaining 3% . It is obvious that the situation in the BPPO remains the same, which means that the previous indications of the Ombudsman to improve the situation in this regard are ignored, added Ziberi.

He pointed out that the situation is similar in the Higher Public Prosecutor's Office and the Prosecutor's Office of RSM, for which he made a serious remark that these institutions take serious steps to improve the situation and for another fact - to create citizens' trust in these institutions, primarily the judiciary and prosecution. why the representation of all communities equally in the population goes in favor of creating greater trust in the decisions of these institutions.
