The victims of the tragedy in Bulgaria are covered by European insurance

Determined circumstances in the investigation procedure for the bus accident are a precondition for starting procedures for insurance compensation - say from the Insurance Supervision Agency

All injured people will be materially compensated, as well as people close to those killed in the bus accident that occurred on the territory of the Republic of Bulgaria, in which 45 passengers were killed in a bus of the company "Besa Trans", and seven were injured, say for "Free Press" representatives of the Insurance Supervision Agency (ISA).

- In order for the compensation process to begin, the ongoing investigation into the unfortunate event must be completed. The established circumstances in the investigation procedure for the bus accident are a precondition for initiating procedures for insurance compensation - say from the Insurance Supervision Agency.

The insurance companies in Macedonia that we contacted, add that the compensation of first-degree relatives and survivors of the accident will be realized according to European norms, because the accident happened on the territory of a member state of the European Union.

According to the interlocutors, all relatives of the victims and survivors are entitled to compensation for material and non-material damage. The non-material refers to the hospital treatment, and the material to the injuries suffered, if any, which refers to those who survived the accident. The members of the immediate family of the victims are also entitled to material damage. These include first-degree relatives, such as parents, spouse, children, or father-in-law and mother-in-law. This insurance is entitled to them according to the Green Card that the vehicle had. Compensation is realized according to the laws and rules of the country where the accident took place. In this case, the compensation and maximum payments will be made in accordance with Bulgarian law.

The president of the Association of Victims of Traffic Accidents from Bulgaria, Vladimir Todorov, told the local media that in terms of compensation, every bus traveling on their roads has "civil liability" insurance or "green card" insurance.

- There is special travel insurance, with lower levels of compensation. The borders in Bulgaria are at the level of 5 million euros. In the Republic of Northern Macedonia there are about 600.000 euros - said Todorov.

He added that relatives of the deceased must file claims against Macedonian insurance companies.

- Our prosecution and investigators are leading, and the relatives of the deceased are a passive party. A criminal case may not be opened if the driver is found guilty of the accident. Then there will be no court phase, because there will be no one who will be tried - said Todorov.

According to him, if the cause of the accident is only a driving error, the insurer will pay the relatives. However, if there is a problem with the infrastructure, the insurer could contact the road owner. If it is determined that the condition of the road contributed to the accident, the Bulgarian state will have to pay compensation. Compensation is paid only after it is determined who is guilty.

Total compensation of about 12,5 million euros?

Experts from Bulgarian insurance companies expect the amount to reach at least 25m leva (12,5m euros).

- Between 100.000 and 125.000 euros can be requested by each of the parents if their child died in the accident. Adult children without parents can receive up to 100.000 euros for a lost parent, and for a deceased brother, sister, grandmother or grandfather the amount is around 25.000 euros - writes the Bulgarian "Blic".

All persons who were in the vehicle that caused the accident are entitled to compensation. The injured party, or his relatives, should submit a claim for compensation to the responsible insurance company. A lawsuit can be filed even after the injured party is not satisfied with the determined compensation in an out-of-court procedure.
