A total of 52 years in prison for the murder of handball player Dennis Toth
The Judicial Council at the Basic Criminal Court Skopje today declared the defendants guilty in the case of the murder of the Croatian handball player. Dennis Toth.
The trial is led by judge Elena Ilievska Josifovi.
In this process, the Basic Public Prosecutor's Office - Skopje is prosecuting the accused for the crime of "murder" from Article 123 paragraph 1 in connection with Article 22 of the Criminal Code. According to the indictment, the defendants charge that on April 7, in front of a night club in the City Park in Skopje, they jointly deprived the injured Denis Tot of his life.
During the evidence procedure, the defendants, at first, stated that they did not feel guilty. The prosecution then produced evidence relating to the indictment. Material evidence was produced, including the video recording of the specific event, testimonies of eyewitnesses to the event, as well as experts in the field of forensic medicine and psychiatry.
During the evidentiary procedure, through the presented evidence and statements to the media, the defense alluded to the requalification of the crime, because, according to them, the crime of "murder" for which the defendants are accused lacks intent. They also questioned eyewitnesses to the event, as well as experts in the field of psychiatry and psychology, and at their suggestion, the doctors who treated the injured Dennis Toth after he was admitted to the Anesthesia, Resuscitation and Intensive Care Clinic also testified.
After the end of the evidentiary procedure, the prosecutor Tanja Trajchevska asked for a guilty verdict, while the defense and the defendants asked for an acquittal.
