The Judicial Council amended the rules for ranking candidates for the election of a judge in a higher court

At the 488th session, the Judicial Council reviewed and passed amendments to the Rulebook on the method of ranking candidates for the election of a judge in a higher court, which fulfill some of the recommendations noted in the report of the EU Evaluation Mission on the work of the council. Any additional work of the judge will be taken into account, and the delegation of the judges with the changes will not be considered as a punishment, but as a reward and will add points, and the mentoring of the judges and the performance of functions after the completion of mandates will also be scored, as who is a member of the Judicial Council, director, deputy director of the Academy, judge of the Constitutional Court, public prosecutor or judge of the International Court.

The President of the Judicial Council, Vesna Dameva, in the explanation of the point, said that the amendment and addition of the Rulebook on the method of ranking the candidates for the election of a judge in a higher court was a necessary activity in the direction of the implementation of the given recommendations of the European Union, noted in the report of the EU Evaluation Mission, for which the Judicial Council also adopted an action plan.

- During 2020, a rulebook was adopted on the method of ranking for the selection of judges in a higher court, but during the work and the procedure for the selection of judges, there was a need to amend certain provisions regarding the method of ranking candidates for selection of a superior court judge. The recommendation was to speed up the process of evaluating the work in relation to the promotion of judges in order to fill certain positions faster, not to wait too long to approach the evaluation of the current new system and to make adjustments where necessary, said Dameva .

The time frame for implementing this activity in the Action Plan, Dameva indicated that it is the month of June 2024, but with financial support and the project from the EU, the changes and additions to the Correct Plan were made much earlier.

- The changes are in the direction of real verification of the results and the commitment of the judges, and which weaknesses were ascertained during the implementation of the by-laws. During the selection procedures in a higher court, the Judicial Council found that with this by-law, the work and commitment of the judges during the performance of their judicial function is not sufficiently taken into account, so these changes are being made. Any additional work will be taken into account by the judge, and the delegation of the judges with these changes will not be considered as a punishment, but as a reward and will add points. For the sake of consistency in the course of the procedure, clarifications were made, and with that, in the future, there will be no room for the commission's discretion, said Dameva.

The changes and additions, Dameva clarified, will be valid in the future when announcing new announcements for the selection of a judge in a higher court, and the current procedures will be carried out according to the current rulebook.

The member of the Judicial Council, Selim Ademi, said that the changes were made to correct the scoring.

- We are changing the criteria in the professional title section, where is the language section, instead of a total of 40 there are now 29 points, because they are given to others. Until now, only the doctoral thesis was evaluated and the points were doubled, and the part of master's judges was not evaluated. Now we have decided that the judge will have one point if he has a master's degree, and two points if he has a doctorate. In another paragraph, it is specified what is a publication and what is a professional title, in order to specify it. Also, in the section of educational materials for the Academy, we decided that the letter should be from the Academy and not from the candidates. Another change is that for knowledge of a foreign language from level C, which was 15 points, we are canceling them and giving 5 for level C, three for level B and one for level A. We are also clarifying and erasing the dilemma that a candidate can prove his knowledge of a foreign language before the Commission of the Judicial Council, clarified Ademi.

The registration of candidates for voluntary delegation to another court, Ademi pointed out, will be scored and thus stimulated, and the mentorship of judges and the performance of functions after the completion of mandates, such as a member of the Judicial Council, director, deputy, will also be scored. director of the Academy, judge of the Constitutional Court, public prosecutor or judge of the International Court.
