Spasenovski: Constitutional amendments with delayed effect are legally possible, Macedonia has already done this once

The university professor of Constitutional Law and former deputy and official of VMRO-DPMNE, Aleksandar Spasenovski, in tonight's appearance on the show "Win-win" on "Thelma" television, about the proposal of the leader of VMRO-DPMNE Hristijan Mickoski about the delayed entry into force of the constitutional amendments, at the time of the country's accession to the EU, says that from an internal legal point of view this is possible, stating that Macedonia has a practice with delayed constitutional amendments.

"Regarding the delayed implementation of the constitutional amendments, here we have to distinguish between technical internal possibility and real political feasibility of the idea of ​​delayed implementation of the constitutional amendments. If we analyze from an internal legal point of view whether it is possible, the answer is yes and it will be foreseen in the constitutional law for the implementation of the Constitution, which would be stipulated immediately after the decision to promulgate the Constitution. We have already done that once, after the last constitutional amendments of 2019, when in the constitutional law for the implementation of the Constitution, Article 1 provided that these constitutional amendments will enter into force at the moment when the validity of the Interim Agreement ceases, and when the Protocol for the country's membership in NATO came into force", explained Spasenovski.
