
The Parliament will not challenge the initiative to dismiss Ljupco Kocevski, says Gashi
The President of the Assembly, Afrim Gashi, stated that the parliament will act in accordance with the procedures if a proposal to dismiss State Public Prosecutor Ljupco Kocevski arrives from the Government, even if the Council of Public Prosecutors gives a negative opinion.

"If we receive an initiative proposed by the Government, we will probably need to review it in more detail once again, but we are guided by the procedures we have. Then, if the proposal is voted on and someone invokes constitutionality, then the Constitutional Court is competent to assess whether the Parliament acted in accordance with the Constitution and the laws. We do not value constitutionality and orderliness in the procedure," said Gashi in an interview with MRT's "360 Degrees".
He emphasized that as President of the Assembly, he is obliged to act according to the Rules of Procedure, the Law on the Assembly and the Constitution, and that any proposal that meets these criteria will be put into procedure.
According to the law, a state prosecutor can be dismissed if he or she commits a serious disciplinary violation or is a member of a political party. However, it remains unclear who should determine whether a serious disciplinary violation has been committed.
"Let's not prejudge. Let's see how the Council of Public Prosecutors will declare itself. Then we will see how the Government will react. We as the Assembly will act exclusively on the basis of the Constitution and the Rules of Procedure," Gashi added.
Justice Minister Igor Filkov has already stated that the negative opinion from the Council of Public Prosecutors does not mean that the procedure is over. He reminded that when selecting a new state prosecutor, the Government can only propose a candidate for whom the Council has previously given a positive opinion.
