Pendarovski reacts: A new law on pardon is being prepared, not on amnesty

This is not about drafting a new law on amnesty, but about preparing a new law on pardon, said today President Stevo Pendarovski, answering a journalist question about the announcement of Deputy Minister of Justice Agim Nuhiu that such a law is being prepared.

Pendarovski clarified that at the initiative of the Ministry of Justice, the new law on pardon has been in preparation for several months.

- I have my experts who participate in the working committees and as far as I know, that text is now in the Government and should go to the Parliament, said Pendarovski.

Explaining the idea that they wanted to be achieved, Pendarovski pointed out that with the changes, if accepted by Parliament, the President at the proposal of the Ministry of Justice will be able to pardon only after the verdict becomes final.

- Now the president has the right at the initiative of the Ministry of Justice to pardon a person at any stage of the procedure, from the arrest and when he is serving his sentence. I support that approach. The idea was now with those changes if they are accepted by the Parliament, the President of the proposal of the Ministry of Justice to be able to pardon only after the verdict becomes final, informed Pendarovski.

According to him, the judicial system should be left to expel the procedure, to face the arguments of the Prosecution and the defense and finally if the president thinks, when the whole procedure is over and that verdict becomes final, to react if there is some room for correction of that judgment.

- We have had several controversial situations in the past 20 years, whether for political reasons or I do not know for what other reasons, someone pardoned someone at an early stage of the procedure. The judicial system should be left to prosecute, the arguments of the prosecution and the defense should be confronted and in the end if the president thinks that when the whole procedure is over and that verdict becomes final that there is some room for correction of that verdict, then it is allowed to "Entered" the process, and not the first, second or third day to rule and say "There will be no further proceedings," which practically de facto derogates the entire judicial system, said Pendarovski.
