BPPO for the case "Rashkovski": Four people are under investigation for procurement of software

The competent public prosecutor from the Basic Public Prosecutor's Office for Prosecution of Organized Crime and Corruption yesterday issued an Order for conducting an investigation procedure against four persons for whom there is a reasonable suspicion that they have abused their official position and authority.

In the period from January 2019 to July 2020, the first suspect as an official, assisted by the other suspects, intentionally committed three time-related actions, which are multiple accomplishments of the same act.

Prior to conducting the public procurement procedure, the first suspect negotiated the procurement of the software with the third suspect by submitting his own patent for which he gave instructions for preparation of a technical specification for the public procurement. The fourth suspect, as an external collaborator, transmitted information about the course of the procedure to the suspects - participants in the public procurement.

During the public procurement procedure, instead of communication, to be performed using electronic means through the Electronic Public Procurement System, in order to favor a specific economic operator, the first suspect personally defined the technical specifications that refer to the patent.

On 02.01.2020, the first suspect made a Decision for selection of the most favorable bidder for the economic operator where the owner and manager is the second suspect and a Contract for procurement of services was concluded. In July of the same year, the economic operator submitted an invoice in the amount of MKD 4.997.300,00 with 18% VAT included, so although the software was not implemented, the invoice was paid within seven days.

In the summer of 2019, the first suspect made two more decisions for public procurement of works for the needs of the software, although at that time no contract for procurement of such software had been concluded yet. Contracts in the amount of MKD 1.416.000,00 with 18% VAT included and MKD 4.605.021,00 with VAT included were selected with the selected economic operators as the most favorable bidders.

With the actions he performed, the first suspect, by not performing his official duties during the public procurement procedure, conducted public procurements contrary to the principle of economy, efficiency and effective use of public funds, determined in accordance with the regulations governing the use of budget funds and for three economic operators obtained a benefit - the right to participate in the public procurement procedures and to conclude contracts for the same and to gain illegal property benefit to the detriment of the Budget of RS Macedonia in the total amount of 11.018.321,00 denars.

The competent public prosecutor, estimating that there are circumstances that indicate that there is a danger of escape, hiding and influencing witnesses for the two first suspects, submitted to the Preliminary Procedure Judge at the Basic Criminal Court Skopje a Proposal for detention. For the other suspects, he proposed to the court to impose precautionary measures, such as a ban on leaving the residence, ie residence; obligation of the suspects to report occasionally to a certain official or a certain state body; temporary confiscation of a travel or other document for crossing the state border, ie prohibition for its issuance and prohibition for undertaking certain work activities related to the crime, ie prohibition for participation in the implementation of public procurement procedures.

Following the several-day articles in the media about the procurement of the software, the prosecution opened a pre-investigation procedure on March 18 this year. Several orders were issued to collect the necessary documentation, which is being acted upon by the investigators from the Investigation Center at the Basic Public Prosecutor's Office for Prosecution of Organized Crime and Corruption.
