New transitional rules in CEFTA: Instead of four, the EUR1 declaration will be valid for 10 months

More flexible conditions for less administrative bureaucracy and more exports are the most important benefits of the new rules

An increase in the share of non-preferential materials in finished agricultural products from 10 to 15 percent by net mass and a set tolerance of 15 percent for industrial products, without origin based on the ex-works price of the final product, except for textile products, are part of the news. to the new and simpler CEFTA transitional rules, which came into effect on February 1.

What is expected to further increase the export competitiveness of the CEFTA member countries is the fact that EUR.1 or the declaration of origin will be valid as the only type of proof of origin and its validity has been extended from four to 10 months. There are also options for contracts for the application of the system of registered exporters and contracts for the use of a proof of origin issued and/or submitted electronically. The new step CEFTA is taking towards trade facilitation focuses on reducing administrative red tape and increasing the volume of trade.

The application of the transitional rules for the preferential origin of goods will be implemented together with the rules of the Pan-Euro-Mediterranean (PEM) Convention. The CEFTA Secretariat says that pending the revision of the PEM Convention, most contracting parties, including CEFTA, the EU and EFTA, have decided to allow companies to use the modernized and simplified rules of origin and have started applying transitional rules on bilateral basis.

– By applying the revised, more flexible and modern rules, the parties will be able to increase their export competitiveness. Transitional rules on the origin of goods simplify the system, simplify the determination of the origin of goods and further facilitate trade in CEFTA and with the EU - explained the director of the CEFTA Secretariat, Emir Dzikić.

The PEM Convention is an international agreement that aims to establish a single set of rules on the origin of goods. In 2013, the contracting parties of the PEM started a discussion on the revision of the Convention, in order to adapt it to the economic reality. Since the adoption of the revised convention failed in 2019, most contracting parties decided to apply the revised rules in advance. Currently, two sets of rules will be applied in parallel, the original PEM rules of origin and the transitional rules, and economic operators will be able to choose between the applicable rules.

Otherwise, the new rules entered into force on February 1, 2023, after all CEFTA members have finalized their internal procedures.
