"In this case, the defendants are charged with several specific actions, but also the intention without which the crime can not exist. It is indisputable that an event took place, but it is not clear which of the defendants took which action and for the Court it is unclear which of the defendants took which action and with what intensity. Pursuant to Article 397 paragraph 1 of the LCP, the Court finds that it is necessary to supplement the procedure and clarify certain issues and therefore the procedure will be reopened. In presenting all the evidence, the question of the force used, threat and resistance is unclear to the members of the council. Certain circumstances remained unclear and there is currently a factual impediment to a court decision. It is necessary to reopen the main hearing for these reasons and that is why the next hearing is scheduled for July 8 ", said Judge Ristovska.
The first accused in this case is the former director of UBK, Sasho Mijalkov, who in the indictment filed by the former SPO, is accused of the crime "torture and other cruel, inhuman or degrading treatment and punishment" under Article 142 paragraph 1 above. with Article 23 of the CC. Six former members of the "Alpha" unit are suspected of the same crime, including Ivica Anchevski, Novica Stankovski, Petar Milosevski, Filip Atanasov, Jovan Bocevski and Metush Shabani.
