Left will file a criminal case against Gashi for the law on defenders
The Rules of Procedure provided for a protective mechanism, in case the president of the committee does not schedule a session, the President of the Assembly will do so. After the interpellation, the President of the Assembly Afrim Gashi will receive a criminal complaint from the deputies of Left because he violated the Rules of Procedure and did not convene the Social Policy Commission for the Law on Defenders, after the president of the working body refused to do so Ilire Dauti. Gashi from the parliamentary desk kept the criminal case silent, and until the afternoon he did not send an answer to the parliamentary group of SDSM, who requested a written report from the parliamentary speaker as to why she does not schedule a session of the Commission.
The Member of Parliament of the Left Sashko Janchev in a procedural address, he addressed Gashi that his intention is that the law on defense attorneys will never be on the agenda and that is why he did not schedule the Commission, which violated the Rules of Procedure and that therefore they will file a criminal complaint against him. He also accused the ruling VMRO-DPMNE of not wanting to pass the law on defenders.
- A commission cannot review a law, then there is no commission. The rules of procedure also provided for a protective mechanism, i.e. in case the president of the commission does not schedule a session, the president of the Assembly will do so. MP and President of the Left Dimitar Apasiev stated that in the case of the law on defenders Gashi violates the new Rules of Procedure and that there is a political and legal moment.
- The legal point is that Gashi blatantly violates the new Regulations and our legal team is considering filing a criminal complaint against him for negligent performance of the service, that is, exceeding discretionary powers. The possibility of not convening the commission lies only with the president of the parent body, but not with the speaker. He has a binding norm - that he is obliged to convene, if he does not convene the committee within 24 hours, and there is nothing to interpret here. So that's the legal liability. The political responsibility, in our opinion, lies with DPMNE, because this shows why a party with two deputies should not have a speaker. Because for every squeak like this, you will have to "kiss the hand" with the speaker and here the political responsibility lies with these 58 MPs - Apasiev believes.
According to parliamentary sources, the parliamentary group of SDSM requested a written response from the President of the Assembly, after Gashi, earlier at the coordination meeting, as well as in the response to the media, claimed that he could not convene the Commission, because President Doughty had already convened a commission. Gashi overlooks the fact that Doughty did not open a debate on the law on defense attorneys, although the speaker of the assembly instructed the president of the working body to schedule a commission on defense attorneys through a letter. This provoked the deputies of SDSM to demand a written answer from Gashi. SDSM expects Gashi to do the same as he did with the Hungarian loan law. Depending on the answer of the president of the parliament, SDSM stated in the letter that if he does not apply the same principle, they expect an explanation and that he will take all the democratic mechanisms at their disposal.

Unofficially, SDSM pointed out to Gashi that he was setting an unprecedented precedent. This will mean that in the future any chairman of a committee can selectively introduce laws and thus they get stuck in the Parliament. The intention of the social democrats is a written confirmation from the President of the Assembly about the precedent set.
Gashi claims that he did not violate the Rules of Procedure, and in order to resolve all the ambiguities, he announced that he would request that they be reviewed by the parliamentary Committee on Rules of Procedure, but it was not convened either.
- We want to clarify once again that the session of the Commission for Social Policy has already been convened by the president Ilire Dauti in accordance with the deadlines stipulated by the Rules of Procedure. Hence, there is no operational basis for the President of the Assembly to intervene or call an additional session of this commission - say Gashi's office.
The Prime Minister Hristijan Mickoski stated that the president of the Parliamentary Commission should put the law for the defenders on the agenda, but also that they did not discuss the law with the government partner Vredi, nor about equal rights that the defenders have and the former members of the NLA.
Ilire Dauti from the European Front expressly replied to Mickoski that he does not receive orders from anyone.
– The prime minister should know that the executive authority has no right to interfere with the legislative authority, let alone the prime minister. On the contrary, the Parliament can issue orders to government officials. I repeat, until a general solution is provided that treats NLA defenders and fighters equally, that law will not be on the agenda. Keep your orders for Value - says Doughty.
