Kacarska demands from Xhaferi to immediately elect four new constitutional judges
The President of the Constitutional Court Dobrila Kacarska today sent a letter to the President of the Assembly, Talat Xhaferi in which it expresses concern about the situation with the reduced number of judges and demands Xhaferi to assert his authority and to be in the Assembly choose four new ones constitutional judges вoh soon.
Kacarska, in the letter to Xhaferi, points out that The Constitution defines the Republic of Northern Macedonia as a parliamentary democracy in which the separation of state power is a fundamental principle, and the Constitutional Court as a body of the Republic protects constitutionality, legality and human rights and freedoms.
- For these reasons, I address you to inform you about the situation in which the Constitutional Court is and its difficult functioning in the last period with only five judges, although the Constitution provides for the full composition of the Court to be nine judges. This has an impact on decision-making when it often happens that the proposal does not get the required majority, which is why at the moment 16 cases can not be decided due to insufficient majority. In addition, I must mention that before the Court should be considered cases that are of top interest to the state, and which need to be decided in full composition, which would make the decisions more weight, says Kacarska in a letter to Xhaferi.
Kacarska also expressed confidence that Xhaferi was informed about the situation and that a solution was already being sought for the election of four new constitutional judges.
