Iliev: The decision of the Administrative Court on the ballots is a precedent
Former President of the Supreme Court and former member of the SEC Dane Iliev comments on the decision of the Administrative Court to be declared valid and unsealed ballots as a precedent so far and sees in it insufficient knowledge of the matter of the election process among judges.
- This has neither been so far nor legally substantiated. "In my practice so far, I have not come across such a decision that gives legitimacy to ballots without a stamp when the Electoral Code in Article 109 paragraph 2 specifically prescribes the voting procedure," Iliev told Sloboden Pecat.
This reaction from the competent judicial public comes after today's decision of the SEC to annul the decision made yesterday for amending the Guidelines for valid and invalid ballots, after, as they emphasized in the SEC, they were misled by the decision of the Administrative Court which annulled the voting at one polling station in Suto Orizari.
Namely, the Administrative Court made a decision declaring ballots without a stamp valid with the explanation that the will of the voters was clearly expressed and they can not be considered invalid only due to the absence of a stamp.
