"Environmental and Social Management Plan" of the modular hospital in Tetovo, which the municipality announced yesterday that they are not competent, is posted on its website.
It is posted on the website of the Municipality of Tetova the document that regulates the obligationsand competencies regarding the modular hospital in the city. The document, in original in English, the same one published by the Ministry of Labor and Social Policy, was taken over by the Tetovo municipality on October 16, 2020. DW checked the content of the document, which is in PDF format, and determined that it is identical content. At the time of publishing this text, we still do not have an explanation from the municipality why the document was published with them, if they did not have jurisdiction over it. The moment we receive an explanation, DW will publish it.
The municipality claimed yesterday that it has no jurisdiction regarding the hospital and referred to the amendments to the Law on Construction made by the government in November 2020.
"In this regard, we inform you that based on the latest amendments to the Law on Construction (Official Gazette of the Republic of Northern Macedonia No. 279 of 24.11.2020) in Article 4 we quote the article: in Article 74 in paragraph (2) after the words:" The decision is issued by the body of the state administration responsible for performing the activities in the field of spatial planning ", the words are added: and the decision is issued by the Ministry of Health ”.
Competencies
The municipality claims that the competence for the modular hospital was solely with the Ministry of Health and other central bodies.
"Communal inspectors do not have the authority to perform controls on special facilities and buildings of the first category. "Security and fire extinguishing systems and control of their functionality are also under the jurisdiction of the Ministry of Health and other institutions at the central level," reads the reaction from the Municipality of Tetova.
"Regarding the water supply and sewerage installations, we would like to inform you that they were in the competence for construction by the contractor, and the municipality only connected them."
The Ministry of Health, for Telma TV, today rejected these claims of the municipality.
"Modular covid centers do not fall into the first or second category, which means that they are not buildings that require a building permit. The amendments to the law on construction define the modular prefabricated buildings in the category of buildings that do not require a building permit, hence the legislation does not provide for supervision of works.
Handover with minor remarks
The documents from the handover of the modular hospital in Tetovo, performed on April 14 this year confirm that it was done in the presence of representatives of the Ministry of Labor and Social Policy, the Ministry of Health, the contractor "Brako" and the economic director of the Tetovo hospital Artan Etemi. The ink minutes additionally list the remarks (which can also be seen on the facsimile) which the builder then repaired:
To clean the showers; To repair a panel in the ren (t) gene room; To repair the floor in the corridors; Close the supply cables in a metal box; and To set up a protective fence at the exit of the hospital - a request that was outside the contract, but was realized a few days later.
According to the documentation, from the moment of handover, in the so-called operational phase, the competencies and the obligation for supervision of the facility had the management staff of the hospital in cooperation with the municipality.
For example, in the section Plan for regular maintenance of the installations (water, drainage network, electricity, heating) in the modular hospital as competent are listed: representatives of the municipality of Tetovo, the director of the hospital in Tetovo, communal inspector and responsible person in the hospital). In the following item, Preparation of a Plan for fire protection and implementation of protective measures as competent are listed: the director of the hospital in Tetovo and a responsible person in the hospital); and in the third item of the operational plan entitled Preparation of a plan for waste management and infection control are responsible representatives of the municipality of Tetovo, the director of the hospital in Tetovo, communal inspector and responsible person in the hospital.
